GENERAL CONDITIONS OF PURCHASE
The following is the contractual document that will govern the contracting of products and services through the website www.losencajeros.es owned by HIJOS SUCESORES DE MANUEL MENDOZA SA, with tax identification number A48005888, hereinafter referred to as the COMPANY.
These terms and conditions shall be valid for an indefinite period of time and shall apply to all purchases made through EMPRESA’s HTTPS://LOSENCAJEROS.ES/ website for the delivery of the same. However, if the user is domiciled in the Canary Islands, Ceuta and Melilla, he/she will have to contact the commercial staff of EMPRESA, in order to apply the tax specialities that these territories have. If the delivery of the product is to be made in the Balearic Islands, it is possible that, depending on the products selected, the website may ask you to contact a sales representative to manage your order.
EMPRESA will keep each contract including the customer/user details, the products purchased, method of payment, place of delivery and the rest of the circumstances relating to the purchase of the products. In any case, the contract shall refer to these General Conditions as a regulation of the obligations between the parties.
Likewise, we inform you that these conditions will be permanently available to users of the website.
The contracting procedure may only be carried out in Spanish. In the event that it could be carried out in any other language, this will be indicated before starting the contracting procedure.
COMPANY reserves the right to unilaterally modify these Conditions, without affecting the goods or promotions that were purchased prior to the modification.
The acceptance of the present document implies that the User:
Has read, understands and understands these General Conditions of Purchase.
That he/she is a natural or legal person, over 18 years of age and with sufficient capacity to contract and meets the legal conditions to enter into the purchase contract carried out through this website.
That he/she assumes each and every one of the obligations established herein, which will regulate the present purchase process.
IDENTITY OF THE PARTIES
On the one hand, the provider of the goods or services contracted by the User in COMPANY, registered in the Bilbao Commercial Register in the name of COMPANY with N.I.F. number A48005888 registered office at www.losencajeros.es.
The User, identified as on the website by means of an e-mail address and password, for which he/she has full responsibility of use and custody, being responsible for the veracity of the personal data provided to the provider.
OBJECT OF THE CONTRACT
The purpose of this contract is to regulate the contractual relationship of purchase and sale that arises between the COMPANY and the User at the moment in which the User accepts the corresponding box during the online contracting process.
The contractual relationship of purchase and sale entails the delivery, in exchange for a specific price and publicly displayed through the website, of a specific product or service.
RECRUITMENT PROCEDURE
The User, after reading these general conditions and accepting them, may place an order for the Product through the website www.losencajeros.es.
In any case, the verification of the terms of the order will be the sole responsibility of the User and the purchase process cannot be initiated until the User has not sent the confirmation of the terms of the order.
In order to access the services offered by the COMPANY, the User must register through the website by creating a User account.
The access data to the website HTTPS://LOSENCAJEROS.ES/ consists of a user name and a password, both provided by the User.
The User undertakes to make diligent use of these access data, not to make them available to third parties and to immediately notify the COMPANY of the loss or theft of their password and possible access by a third party. In this sense, the USER is responsible for the security of his access data.
The USER accepts responsibility for all activities that occur under his/her e-mail address and password.
The USER may access his/her profile via the links on the right-hand side of the navigation.
The USER must pay particular attention to the following:

The USER must ensure that no unauthorised person can obtain the password.
The USER is obliged to change or cancel his/her password immediately if he/she becomes aware or suspects that another person or third party knows, uses or has used the password. If this is not possible, the User must notify the COMPANY immediately. In this case, COMPANY will block the User’s account, restoring it once new passwords have been assigned.
Once the User account has been created, it is informed that in accordance with the requirements of art. 27 of Law 34/2002 of Services of the Information Society and Electronic Commerce, the contracting procedure will follow the following steps:
PRODUCT SELECTION
The selection of products will be effective each time the User clicks on the purchase icons on which the word “buy”, “add to cart”, “buy now” or similar expressions will be visible.
It will be possible to make different selections, which will be accumulated in the virtual basket or “cart”.
The virtual basket or shopping cart is located in the upper right-hand side of the navigation area, where the data necessary for the identification of the products that have been accumulated will be visible.
Each time the user accesses the virtual shopping cart, a) they can access the registration area to identify themselves; b) they can view and edit the billing and shipping information; c) they can access and view the details of their order information, where they can update the number of units of each article, update the economic calculation, select the shipping method, select the payment method and insert the promotional code so that the corresponding discount or promotion can be applied.
ORDER PLACEMENT
Shipping details: Once you have selected the “buy now” command in the virtual shopping cart, you will be automatically redirected to the user identification screen, where you must enter your login details, if you have not previously identified yourself. If the user has not registered as a user, he/she can do so in the attached form.
In this step, the User will be given the opportunity to indicate their shipping address preferences, choosing between the billing address and another shipping address that they can indicate at the time if they have not done so before.
Payment method: The User will be able to select the payment method he/she wishes, following the link “Select payment method”.

Once the User has indicated their preferences, they must select the “buy now” command to continue with the purchase process.
User Confirmation
On the confirmation screen, the data related to the order will be summarised: delivery address, selected products, billing address, payment details, amount accumulated in the cart, shipping costs, costs for the means of payment and total cost of the purchase.
The User must pay special attention to this information and verify that the entire order is in accordance with his/her preferences, and if this is not the case, he/she may make the changes that he/she deems appropriate, using the links that will be available according to the terms that he/she wishes to modify.
Likewise, before confirming the Order Confirmation, the User must rectify any error or inaccuracy that may exist in the order and verify that all the data entered is correct.
Once the User verifies that the data is correct, he/she must select the “confirm purchase” command to conclude the purchase process.

By credit card
No surcharge, and immediate processing once the charge has been accepted on the card.
By bank transfer or deposit in a bank account:
No surcharge. The processing of the order will be held until the payment is confirmed. The order may be cancelled if the bank deposit or transfer is not confirmed within 3 days from the date of the order. Transfers must be made in Euros, and commissions are payable by the sender.
BIZUM
No surcharge.
DELIVERY OF ORDERS
Delivery Address: Once the purchase process has been completed, we will send the products purchased to the designated address. Therefore, the User is responsible for the veracity and correctness of this postal address, and COMPANY is not responsible for delivery errors or expenses caused by problems associated with erroneous or incomplete addresses.
Once your order is manufactured and ready to ship (30 to 60 days), it will reach you within approximately 7 working days. This applies to both domestic and international orders. All our shipments are sent by courier.
The cost of delivery depends on the destination of the purchase. The rates are informed at the time of checkout and are determined by the destination.
If the package is damaged at the time of delivery, please contact us within 24 hours and we will contact the courier company.
Important note: customs charges for international orders outside the European Union are not included.
PRICE AND PERIOD OF VALIDITY OF THE OFFER
Price of the products: The valid price of each product for deliveries in the Spanish peninsular territory and the Autonomous Community of the Balearic Islands is that published on our website, and is designated per product unit.
All prices published in the COMPANY are in Euros and are valid except for typographical errors. All prices include the VAT applicable on the day of the order, any change of VAT rate will be automatically applied to the prices of the products on sale in the COMPANY.
Product: The offers presented by the COMPANY are valid within the limit of available stock. The COMPANY reserves the right to modify the assortment of products according to the constraints imposed by its suppliers.
All purchase orders received by the COMPANY through the Website are subject to the availability of the products and/or that no circumstance or force majeure affects the supply of the same. In the event of difficulties in the supply of products or if there are no products in stock, the COMPANY undertakes to contact the User and reimburse any amount that may have been paid by way of payment. This shall also apply in cases where the provision of a service becomes unfeasible.
TAXATION AND INVOICING
Taxes on the products: The price published on our website for each product includes Value Added Tax (VAT) for those areas that carry VAT and will be valid for the Spanish or European territory in which this tax applies. In areas or countries that do not charge VAT, the final prices will be the same, and your invoice will not reflect the VAT breakdown.
-In the case of special taxes, as is the case of the CANARY ISLANDS, GIBRALTAR, CEUTA, MELILLA, ANDORRA, AZORES and MADEIRA, the prices on the invoice will not include a breakdown of VAT, and local taxes and customs formalities will be charged at the time of DELIVERY and are the responsibility of the customer.
-For orders from NON-COMMUNITY countries, VAT WILL NOT BE DISCOUNTED from the prices.
Invoicing: COMPANY will issue an electronic invoice for each purchase made, which will include all the products purchased in the same purchase process; and which will be sent to the e-mail address designated by the user. The user also has the right to receive the invoice in paper format free of charge, if he/she so wishes.
In any case, the invoice will be sent to the person, natural or legal, who is duly registered as the holder of said registered user, and the user is responsible for the veracity of the data. The invoice, in any of its forms, will be closed at the same time as the purchase process is concluded, in such a way that, in accordance with tax regulations, it is impossible to modify it at a later date.
IDENTIFICATION AND CORRECTION OF POSSIBLE ERRORS
Throughout the purchase process, our systems are responsible for assessing the correctness of the process, guaranteeing both the unequivocal identification of users and their contrast with the password by this designation, as well as the existence of long waiting processes that could lead to errors.
In this sense, when registering as a user, the user is asked to enter the passwords manually, thus preventing unwanted or erroneous passwords from being established as a result of a typing error.
Likewise, during the purchase process, our system is equipped with different routines that constantly check the correctness of the process, debugging any errors and comparing the user’s purchase choices with the information in the user’s order; and all of this is compared with the stock of the products selected.
To this end, the quantities that are assigned to an order in the purchasing process are specified by the customer by means of the unit addition by the purchase buttons or, indicated in numerical format on the forms provided for this purpose, in the steps prior to order confirmation. The website will inform on several occasions during the purchase process of the quantities that the customer has added to their basket, so that, in the event that they are not the desired ones, they can change them at their free choice and avoid possible errors before finalising their orders.
APPLICABLE SAFEGUARDS
Acknowledgement of the Guarantee in favour of consumers and users: The products offered on our website, have the guarantee established in the General Law for the Defence of Consumers and Users, in such a way that COMPANY, as seller of the same will respond to our users in the conditions recognised by the current regulations.
Lack of conformity of the product: The guarantee will cover situations in which there is a lack of conformity of the product purchased, understanding as such that the product does not meet the conditions established in article 116 of the Law.
RETURNS
It is important to know that you cannot withdraw from the contract for the supply of any of the following products:

Products without their original packaging
Products made to measure.
Personalised products
All these products cannot be exchanged, returned or refunded unless the product is faulty or the wrong product has been sent.
If for any reason you are not satisfied with your order, you have 14 working days from the date of receipt to return it.
The first step is to contact us at info@losencajeros.es to provide you with the address to which you should return the goods. The products must be returned in the same condition as they were delivered and in their original packaging. It is important that the products are perfectly packed together with a copy of the delivery note.
We will send the transport company to the address requested for collection.
Once we have received the items and checked that the above conditions have been met, we will proceed to refund the amount.
Shipping costs on returns are paid by the customer (including promotions and offers) except if the product is defective, or by mistake, you have received the wrong item, in which case we assume the cost of collection.
The costs of gift wrapping, shipping and any customs duties and taxes on international shipments will not be refunded.
Data protection policies
In compliance with the provisions of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, we inform you that any personal data you provide us with will be included and processed in the files owned by the COMPANY in order to manage, administer and maintain the Services provided and/or contracted, as well as to keep you informed, including by electronic means, on matters relating to the activity of the Company and its services.
Security and buyer protection
Payments for purchases on www.losencajeros.es are made by credit card through the Redsys payment gateway where SSL protocols are complied with for privacy and integrity in communication using the 3DSecure system, which redirects data to secure servers without the merchant being able to access or store it.
